Hong Kong Marking Made in China
U.S. Customs and Border Protection announced new guidance on country of origin marking rules for products manufactured in Hong Kong. The changes are applicable as of July 29, 2020, with a grace period until September 25, 2020. All goods produced in Hong Kong must be marked with indication that the origin is “China.” Again, this takes effect on September 25, 2020.
One should also note that imports from Hong Kong will NOT receive Section 301 ad valorem treatment as many imports from China do.
Background
On July 14, 2020 President Trump issued an executive order, which states, “pursuant to section 202 of the United States-Hong Kong Policy Act of 1992, that the Special Administrative Region of Hong Kong (Hong Kong) is no longer sufficiently autonomous to justify differential treatment in relation to the People’s Republic of China (PRC or China) under the particular United States laws and provisions.”
