Section 301 List 3 Exclusions Extended
Two hundred and sixty six (266) products from the List 3 exclusions have been extended until the end of the year. Effective September 24, 2018, the U.S. Trade Representative (USTR) imposed additional 10% ad valorem duties on imports from China classified in 5,757 full and partial subheadings of the Harmonized Tariff Schedule of the United States (HTSUS), with an approximate annual trade value of $200 billion and increased that duty rate to 25% in May 2019. This list is also known as the Section 301 List 3 imports from China. Moreover, the USTR, initiated an exclusion process on June 24, 2019, and as of August 2020, has granted 15 sets of exclusions for products on Section 301 List 3 imports from China.
Product Exclusion Extensions
As mentioned before, some of these product exclusions have been extended until December 31, 2020. Therefore, importers can continue to import the items listed below without the added 10% duty by using HTS number 9903.88.56. If an importer has imported product between September 24, 2018 and August 7, 2020 on the original List 3 product exclusions mentioned above, it is eligible for a refund from U.S. Customs through a post summary correction. To date, the U.S. Trade Representative has granted more than 6,700 exclusion requests, has extended some of these exclusions, and may consider further extensions of exclusions. Furthermore, more than 200 requests are pending on the products covered by the action taken on August 20, 2019.
Background
On August 18, 2017, USTR initiated an investigation into certain acts, policies and practices of the Government of China related to technology transfer, intellectual property and innovation (82 FR 40213). During the investigation, the Trade Representative determined that the acts, policies and practices of China under investigation are unreasonable or discriminatory and burden or restrict U.S. commerce, and are thus actionable under Section 301(b) of the Trade Act of 1974, as amended (Trade Act). In response, President Trump initiated a number of actions which imposed ad valorem tariffs on certain imports originating in China. Four separate lists have been announced.
